We were also lucky to have an interview with Dr. Doug Freir, Vice President of Student Affairs to talk about the recent rumors of Winter quarter being cancelled. Listen to the interview below

We have been recording live outside of the library near the MASA house where a group of students have had it with the current administration and are staging a week long protest and occupation at Cal Poly. Today, while we were recording, a student walked by and announced that there was a rumor of winter quarter being closed just like summer. We called the admissions office and had a confirmation from an employee there but we did further research and were able to get an interview with Doug Freir.

Be careful students, because the answers that you hear in the interview are going to be the same answers at the student forum; basically none just a reluctance to actually answer the questions. While it is now "confirmed" that winter will continue as usual, we have to know that the budget is never final and we will never know what will happen or what will be cut. In fact just a few months ago at another university sponsored "student forum" President Ortiz stated that Cal Poly was well off and was one of the most prepared campuses for when the cuts came into effect. I don't think a "well prepared" campus cancels summer; the only CSU so far to do so.

We have to ask ourselves, where is this money really coming from and where is it going? We are in this crisis, and have been in it for a few years now, at the same time that university presidents are receiving outrageous raises and executive perks. Cal Poly has been hiring administrators at an alarming rate when our fees are going up and classes are being cut. Do we really need that many administrators? It's getting to the point were we have Associate Vice Interim Pro Co-President....The longer the name the less we probably need them.

So I will propose something, just an idea. Our faculty are out of jobs this summer, adjunct and full time professors. These are the people that we associate with on a daily basis; they teach us, mentor us, befriend us, guide us and care for us. How often do we see administrators? So, what about a pay cut or a "temporary lay off" of administrators for the summer (like our professors are dealing with). How much money would be saved there? I think it's about time that administrators actually answer to you, the students!

Administration underhandedly announces termination of summer quarter.
On Friday June 6th, Cal Poly Pomona University announced that state sponsored summer courses are canceled. Supposedly the state budget cuts "will directly limit our [the university's] ability to meet student needs for the 2009-10 academic year” said President Michael Ortiz in an email sent to students days before finals week.

Due to this many students that were relying on taking summer courses to fulfill prerequisites, graduation requirements, or classes they can't otherwise get during the regular academic year, are left in the dark with no other option but to postpone their education career. So what is there left to do but to be forced to take out more loans to pay "extra" for this whole extended university scam while there is no guarantee that you will be able to get the class that you need anyway.

Enough is Enough! Clearly, this administration is not capable of nor interested in advocating for students. They blame voters for voting down these so called "budget stabilization" acts, putting the blame on the voters when in fact, even if these acts did pass, we would still be in the same crisis that we are in today, none of those propositions would take in to effect immediately, and instead would offer only a short term solution 2 years from now. Do not be deceived by the people who created this crisis.

We invite you to come and join the Study-In for Summer Classes in front of the University Library. This space was created for and by students to educate each other about the realities of this crisis. Bring your books, laptops, ideas, and rage so that we can show this administration that their plans to "slip" this scandalous decision by us during finals week did not work.

Campaña Nacional e Internacional LIBERTAD y justicia para ATENCO

Traslado de Nacho, Héctor y Felipe a un penal estatal antes del 4 de mayo, demanda inmediata de la Campaña Nacional e internacional

Los obispos Samuel Ruiz García – obispo emérito de la Diócesis de San Cristóbal de las Casas- Raúl Vera – obispo de la Diócesis de Saltillo, y el director del Centro de Derechos Humanos Fray Francisco de Vitoria, el fraile Miguel Concha Malo, hemos visitado hoy a 3 de los 12 presos políticos que se encuentran en prisión a raíz de los hechos del 3 y 4 de mayo de 2006 en San Salvador Atenco. Además de nuestros propios comentarios deseamos declarar conjuntamente que:

Lamentamos que Ignacio del Valle, Héctor Galindo y Felipe Alvarez sigan a casi tres años de los hechos represivos, presos bajo acusaciones que no pueden ser comprobadas y bajo un estricto control carcelario. Estos tres integrantes del Frente de Pueblos en Defensa de la Tierra son parte de un movimiento social cuyas demandas son justas y legítimas. Es condenable el tratar como delincuentes a ciudadanos que se organizan y movilizan en defensa de sus derechos. Estas tres personas no son delincuentes. No han cometido delito alguno. Son presos políticos del Estado mexicano. A nombre de las 130 organizaciones nacionales e internacionales, así como de la treintena de personalidades que integran la campaña nacional e internacional que impulsamos conjuntamente, deseamos sumar nuestra voz a la exigencia que pide la libertad de los 12 presos políticos de Atenco. Demandamos su libertad, ya que es injusto que personas inocentes se encuentren en prisión. Son políticas y no jurídicas las razones por las que se encuentran todavía en reclusión. Su encierro en el penal de máxima seguridad del Altiplano constituye un castigo inusual y desproporcionado al considerarlos y otorgarles el tratamiento de reos de alta peligrosidad

Deseamos denunciar de nuevo, que las personas que hemos visitado el día de hoy, fueron detenidas con fuerte brutalidad policiaca, que han sido procesadas bajo numerosas irregularidades y que la justicia ha sido utilizada de manera facciosa contra ellos. En suma, los casos de estos tres integrantes del Frente de Pueblos en Defensa de la Tierra, son escandalosos casos de violaciones a los derechos humanos. Por otro lado, las condiciones carcelarias a las que se encuentran sometidos son inaceptables. Permanecen en una celda reducida 23 horas al día con luz permanente, sin realizar ningún tipo de actividades. Les dan 3 minutos para ingerir sus alimentos e igual tiempo para ducharse además de ser sometidos a revisiones denigrantes. Se les prohíbe el ingreso de libros, de ropa de abrigo, así como de útiles de aseo personal. Se limita al máximo su contacto con el mundo exterior. Las cartas que envían y reciben son objeto de censura y de límites de extensión. En suma, las condiciones de encarcelamiento son inhumanas y deben detenerse y cambiar de inmediato. Cabe resaltar la suspensión del derecho de visita de Héctor Galindo Gochicoa que nos parece alarmante dadas las restricciones que sufren de por sí al permanecer en este penal. Solicitamos se reestablezcan las visitas de inmediato para Héctor.

Es por ello que ratificamos nuestro llamado al Gobierno Federal y al Gobierno del Estado de México a que trasladen antes del 4 de mayo a Ignacio, Héctor y Felipe a un penal estatal cercano a su domicilio como lo establece el artículo 18 de la Constitución mexicana. No existen argumentos para mantenerlos en este penal. La decisión de mantenerlos en este penal de máxima seguridad hace caso omiso de las opiniones de la Comisión Nacional de Derechos Humanos sobre la ilegalidad de su traslado y la opinión del Poder Judicial de la Federación sobre la ausencia de motivaciones para dicho traslado. Se debe recordar además que las condiciones carcelarias en el Penal del Altiplano contravienen La Declaración de Principios y Buenas prácticas sobre la protección de personas privadas de libertad asumida por la Comisión Interamericana de Derechos, de la cual México es parte. Pedimos su traslado considerando además que el Ministerio Público jamás pudo acreditar la supuesta “alta peligrosidad” que fue la causa invocada para internarlos en el penal de alta seguridad; también porque al paso del tiempo el Poder Judicial de la Federación ha determinado que no se configuró el delito de secuestro equiparado por el cual fueron procesados y sentenciados los compañeros; por esa razón el Tribunal Colegiado ha ordenado al Juez penal del fuero común que deje sin efecto las órdenes de aprehensión giradas en contra de otros dos compañeros acusados del citado delito. Hacemos un fuerte llamado al Gobierno Federal y Estatal a escuchar esta petición.

Deseamos hacer un llamado a la sociedad civil nacional e internacional a sumarse a la Campaña Libertad y justicia para Atenco que viene sumando las voces de quienes demandamos la libertad a los 12 presos políticos de Atenco. Invitamos a la ciudadanía en general a informarse de este terrible caso, a solidarizarse con los presos enviándoles mensajes a través del sitio web de la campaña y a participar en las acciones pacíficas del 3 y 4 de mayo próximos. Sabemos que juntos lograremos la libertad y la justicia para Atenco.

Justice for the Women of Atenco

Last month, the Mexican Supreme Court confirmed that women in San Salvador Atenco suffered major physical and sexual abuse at the hands of police officers. But even with the affirmation of the highest court in Mexico, the women in Atenco are still waiting for these officers to be held accountable for their crimes.

Supreme Court Rejects Abu-Jamal’s Appeal

The Supreme Court yesterday rejected an appeal by Mumia Abu Jamal and his lawyers for a new trial. The former member of the Black Panther Party and award winning radio journalist has remained on Pennsylvania’s death row ever since his conviction in 1982 for the murder of a white Philadelphia policeman Daniel Faulkner. In letting the conviction stand, the High Court dismissed without comment Abu-Jamal’s claim that the composition of his jury improperly excluded African-Americans. His chief defense attorney,Robert R. Bryan, has said that racism was central to the selection of the jury in the case. Joseph McGill, the prosecuting attorney in the Abu-Jamal case, has stated that he used 10 of his 15 peremptory challenges to exclude potential African-American jurors. Such a strike rate eventually led to there being only two African-American jurors in the trial of Abu-Jamal which took place in Philadelphia; a city that in 1982 was comprised of 40% African-Americans. The Supreme Court’s ultimate rejection of Abu-Jamal’s appeal has been seen by some of his supporters, as well asdetractors, as his last chance for a new trial.

No están solos compas, estamos con ustedes rompiendo muros y el silencio que es acomplice a la impunidad!Para nosotr@s la lucha y movimiento para la libertad de tod@s l@s pres@s políticos del mundo es cotidiana. Ya que sabemos que la impunidad y el silencio forman una parte de la estrategia imperialista Yanqui llamada “Doctrina de Seguridad Nacional,” que también forma parte de la represión-una rueda del capitalimso-que se ejecuta en cada otros de los países incluyendo Mexico. Y por eso es porque ustedes están endonde están, por luchar en defensa de sus tierras, usos y costumbres sagradas y ancestrales.

Aca también los que luchan por eso mismo y la justicia social en su propia forma, individualmente o en colectivo, también están perseguidos, asesinados y encarcelados por el estado mexicano.

Por ejemplo, el primer mes del año presente a sido manchado con la sangre de victimas asesinada/os y brutalizado por un auténtico Terrorismo de Estado. Oscar Grant y Annette García estaban desarmados, y les dispararon por la espalda y murieron en presensia de amigos y familiares. Leonard Peltier, preso político desde 1972, fue brutalmente atacado por varios presos desconocidos.

Los asesinos y agresores de estas victimas eran agentes de la misma institución policiaca racista.

Oscar Grant, Africano Americano de 22 años, padre y carnicero de la ciudad de Hayward, California fue ejecutado por policía del metro de la bahía de San Francisco, California (BART) en el Año Nuevo del 2009. El oficial Johannes Mehserle, fue capturado en video por pasajeros del BART metro mientras el oficial asesino atacaba a Oscar Grant aunque coperaba conél.

Entonces fue sujetado contra el suelo boca abajo por otros oficiales. Mientras Johannes Mehserle saco su harma y le disparo asesinándolo por la espalda a Oscar Grant.

Testigos escucharon a Mehserle disiendole a otros oficiales de BART “hagance patras! Que yo me encargo de el.”

El 30 de enero el oficial Johannes Mehserle fue distituido de su cargo policial y fue puesto en libertad bajo fianza.

Annette García, una Activista Chicana de 23 años, madre de 6 hijos y miembro de las Boinas Cafe de Aztlán-Riverside (un colectivo que trabaja para la defensa de las comunidades de gente de color) de la ciudad de Parris, California fue asesinada a sangre fria el 23 de Enero del 2009 (el tercer dia del inicio presidencial de Barrack Hussein Obama) por el departamento del sheriff del condado de Riverside.

En el momento en que ella se retiraba del oficial, el saco su harma disparandole cinco veces y la sexta bala le dio en la espalda. Ella se desangro por una hora antes de que la asistencia medica llegara, falleciendo el los brazos de sus hijos.

Su asesino sigue en libertad y con pago salario mientras se inicia la investigación.

Leonard Peltier, un preso politico que asido encarcelado injustamente desde 1972 por haber luchado en defensa de las tierras ancestrales de comunidades indígenas Norteamericanas, fue transferido a una nueva prision el 13 de enero de este año.

A su ingreso a la nueva carcel fue atacado por varios presos desconosidos. ¿Que acsiones tomaron los guardias? Los guardias actuaron injustamente contra Leonard Peltier separándolo de los demas presos y enserandolo en un calaboso y prohibiendole alimentos sabiendo que él es diabetico.

En una carta Leonard Peltier acusa al FBI por el ataque.

Y ahora están ustedes compas presos políticos de Atenco. Ustedes fueron castigados por el mismo asesino-terrorista que mato a Oscar Grant y Annete Garcia y que encarcelo a Leonard Peltier y Mumia Abu-Jamal entre much@s otr@s-el sistema capitalista-imperialista-neoliberal que mata y destruye todas las posabilidades de paz y democracia en nuestra America.

Ya Basta! Nosotr@s no ponemos nuestras esperanzas por la paz y justicia en las manos del sistema judicial y mucho menos en un gobierno de arriba que castiga a la gente digna y rebelde con torturas, hostigamientos, desplazamientos, desapareciónes y muertos. Este sistema político sólo sirve para protejer y ofrece impunidad a los verdaderos terroristas y asesinos de nuestros países – la policía, políticos, juezes y capitalistas transnacionales.

How You Can Help End the RACIST Checkpoints in Pomona

Supreme Court rules regarding how Pomona's RACIST checkpoints are SUPPOSED to be conducted---and your legal right to protest them...The most important activity during anti-checkpoint & pro-unlicensed/undocumented immigrant driver advocating is:

1. Holding up the warning signs advising drivers of the upcoming checkpoint and

2. Documenting the police as they pull driver's over who turn off the road to avoid the checkpoint.

3. Advocating with the police to release the driver when they pull drivers over who have pulled off the road to avoid the checkpoint when there is no probable cause for pulling them over i.e. no traffic infraction or suspicion of alcohol.

Note that it is best to speak to a commanding officer that you are doing all of the above. You don't want any of your folks to get arrested for interfering with an office in the course of exercising his duty.

The Supreme Court of California rendered a decision on the premiere California roadblock case, Ingersoll v. Palmer, in 1987. This decision set the standard for how law enforcement agencies must conduct roadblocks, otherwise known as sobriety checkpoints. The Supreme Court identified a number of factors for minimizing the intrusiveness on the individual while balancing the needs of society in keeping drunk drivers off the road:

1) Decisionmaking at the Supervisory Level:

Only supervisory law enforcement personnel, and not officers in the field, may make the decision to establish a sobriety checkpoint and select the site. This requirement is important to reduce the potential for arbitrary and random enforcement.

2) Limits on the Discretion of Field Officers:

A neutral mathematical formula, such as every driver, or every third, fifth, or tenth driver should be used in determining who to stop at the roadblock. This requirement takes away the discretion of the individual officer to stop any driver he/she chooses without any legitimate basis.

3) Maintenance of Safety Conditions:

Primary consideration must be given to maintaining safety for motorists and officers. In order to minimize the risk of danger to motorists and police, proper lighting, warning signs and signals and clearly identifiable official vehicles and personnel are necessary. The checkpoint should only be operated when the traffic volume allows the operation to be conducted safely.

4) Reasonable Location:

The location of roadblocks should be determined by policymaking officials rather than by officers in the field. The sites chosen should be those which will be most effective in actually stopping drunk drivers, such as roads which have a high incidence of alcohol-related accidents and arrests.

5) Time and Duration:

Law enforcement officials are expected to exercise good judgment in setting times and durations, with an eye to effectiveness of the operation, and with the safety of motorists in mind. With these considerations in effect, there are no hard and fast rules as to the timing or duration of the roadblock.

6) Indicia of Official Nature of Roadblock:

The roadblock should be established with high visibility, including warning lights, flashing lights, adequate lighting, police vehicles and the presence of uniformed officers. Not only are such factors important for safety reasons, but advance warning will reassure motorists that the stop is duly authorized, thus reducing fright or annoyance to the motorist.

7) Length and Nature of Detention:

Each motorist stopped should be detained only long enough for the officer to question the driver briefly and to look for signs of intoxication, such as alcohol on the breath, slurred speech, and glassy or bloodshot eyes. If the driver does not display signs of impairment, he or she should be permitted to drive on without further delay. If the officer does observe signs of impairment, the driver may be directed to a separate area for a roadside sobriety test. At that point, further investigation must be based on probable cause, and general principles of detention and arrest would apply.

8) Advance Publicity:

Advance publicity is important to the maintenance of a constitutionally permissible sobriety checkpoint. Publicity both reduces the intrusiveness of the stop and increases the deterrent effect of the roadblock. The thought is that advance notice limits intrusion upon the individual's personal dignity and security because those stopped would anticipate and understand what was happening. Further, advance publicity serves to establish the legitimacy of roadblocks in the minds of motorists.

The Supreme Court also stated that motorists who seek to avoid a roadblock may not be stopped and detained merely because they attempted to avoid the roadblock. However, if the motorist commits a vehicle code violation or displays obvious signs of intoxication, there is adequate probable cause to pull over the motorist, after which point general principles of detention and arrest apply.

If law enforcement does not follow the factors set out by the Supreme Court, the evidence gained as a result of the roadblock may be suppressed as an intrusion on the 4th Amendment rights of the motorist.

MARCOS: GAZA WILL SURVIVE

Two days ago, the same day we discussed
violence, the ineffable Condoleezza Rice, a US
official, declared that what was happening in
Gaza was the Palestinians' fault, due to their violent nature.

The underground rivers that crisscross the world
can change their geography, but they sing the same song.

And the one we hear now is one of war and pain.

Not far from here, in a place called Gaza, in
Palestine, in the Middle East, right here next
to us, the Israeli government's heavily trained
and armed military continues its march of death and destruction.

The steps it has taken are those of a classic
military war of conquest: first an intense mass
bombing in order to destroy "strategic" military
points (that's how the military manuals put it)
and to "soften" the resistance's reinforcements;
next a fierce control over information:
everything that is heard and seen "in the
outside world," that is, outside the theater of
operations, must be selected with military
criteria; now intense artillery fire against the
enemy infantry to protect the advance of troop
to new positions; then there will be a siege to
weaken the enemy garrison; then the assault that
conquers the position and annihilates the enemy,
then the "cleaning out" of the probable "nests of resistance."

The military manual of modern war, with a few
variations and additions, is being followed
step-by-step by the invading military forces.

We don't know a lot about this, and there are
surely specialists in the so-called "conflict in
the Middle East," but from this corner we have something to say:

According to the news photos, the "strategic"
points destroyed by the Israeli government's air
force are houses, shacks, civilian buildings. We
haven't seen a single bunker, nor a barracks,
nor a military airport, nor cannons, amongst the
rubble. So--and please excuse our ignorance--we
think that either the planes' guns have bad aim,
or in Gaza such "strategic" military points don't exist.

We have never had the honor of visiting
Palestine, but we suppose that people, men,
women, children, and the elderly--not
soldiers--lived in those houses, shacks, and buildings.

We also haven't seen the resistance's reinforcements, just rubble.

We have seen, however, the futile efforts of the
information siege, and the world governments
trying to decide between ignoring or applauding
the invasion, and the UN, which has been useless
for quite some time, sending out tepid press releases..

But wait. It just occurred to us that perhaps to
the Israeli government those men, women,
children, and elderly people are enemy soldiers,
and as such, the shacks, houses, and buildings
that they inhabited are barracks that need to be destroyed..

So surely the hail of bullets that fell on Gaza
this morning were in order to protect the
Israeli infantry's advance from those men, women, children, and
elderly people.

And the enemy garrison that they want to weaken
with the siege that is spread out all over Gaza
is the Palestinian population that lives there.
And the assault will seek to annihilate that
population. And whichever man, woman, child, or
elderly person that manages to escape or hide
from the predictably bloody assault will later
be "hunted" so that the cleansing is complete
and the commanders in charge of the operation
can report to their superiors: "We've completed the mission."

Again, pardon our ignorance, maybe what we're
saying is beside the point. And instead of
condemning the ongoing crime, being the
indigenous and warriors that we are, we should
be discussing and taking a position in the
discussion about if it's "Zionism" or
"anti-Semitism," or if Hamas' bombs started it.

Maybe our thinking is very simple, and we're
lacking the nuances and annotations that are
always so necessary in analyses, but to the
Zapatistas it looks like there's a professional
army murdering a defenseless population.

Who from below and to the left can remain silent?

Is it useful to say something? Do our cries stop
even one bomb? Does our word save the life of even one Palestinian?

We think that yes, it is useful. Maybe we don't
stop a bomb and our word won't turn into an
armored shield so that that 5.56 mm or 9 mm
caliber bullet with the letters "IMI" or
"Israeli Military Industry" etched into the base
of the cartridge won't hit the chest of a girl
or boy, but perhaps our word can manage to join
forces with others in Mexico and the world and
perhaps first it's heard as a murmur, then out
loud, and then a scream that they hear in Gaza.

We don't know about you, but we Zapatistas from
the EZLN, we know how important it is, in the
middle of destruction and death, to hear some words of encouragement.

I don't know how to explain it, but it turns out
that yes, words from afar might not stop a bomb,
but it's as if a crack were opened in the black
room of death and a tiny ray of light slips in.

As for everything else, what will happen will
happen. The Israeli government will declare that
it dealt a severe blow to terrorism, it will
hide the magnitude of the massacre from its
people, the large weapons manufacturers will
have obtained economic support to face the
crisis, and "the global public opinion," that
malleable entity that is always in fashion, will turn away.

But that's not all. The Palestinian people will
also resist and survive and continue struggling
and will continue to have sympathy from below for their cause.

And perhaps a boy or girl from Gaza will
survive, too. Perhaps they'll grow, and with
them, their nerve, indignation, and rage.
Perhaps they'll become soldiers or militiamen
for one of the groups that struggle in
Palestine. Perhaps they'll find themselves in
combat with Israel. Perhaps they'll do it firing
a gun. Perhaps sacrificing themselves with a
belt of dynamite around their waists.

And then, from up there above, they will write
about the Palestinians' violent nature and
they'll make declarations condemning that
violence and they'll get back to discussing if it's Zionism or anti- Semitism.

And no one will ask who planted that which is being harvested.
